for the use of the cannabis-transparent.de platform
(1) The provider of the cannabis-transparent.de platform (hereinafter “Platform”) is Cannabis-Transparent UG (haftungsbeschränkt), Holzmarktstraße 66, 10179 Berlin, registered in the commercial register of the Amtsgericht Charlottenburg (Charlottenburg Local Court) under HRB 288999 B, represented by its managing director Leonard Metsch (hereinafter “CT”). (2) These Terms and Conditions apply to all users of the Platform, irrespective of their role (§ 3). Deviating terms and conditions of users shall not apply. (3) For paid services (§§ 6, 7), the service and price details displayed at the time of booking apply in addition.
(1) CT operates an independent information and quality platform for medical cannabis in Germany. The Platform combines structured, pseudonymous patient reviews at batch level with independent laboratory analyses in a research cooperation with Humboldt-Universität zu Berlin. (2) CT is purely an information platform. CT does not broker medicinal products, does not process orders and does not handle payments between manufacturers, wholesalers, pharmacies or patients. Contracts for the purchase of medicinal products are concluded exclusively between the respective parties outside the Platform. (3) The Platform does not produce rankings, overall ratings or purchase recommendations. Published reviews are individual reviews or aggregated presentations per individual attribute, stating the source and number of cases — not product assessments by CT. (4) The content of the Platform does not constitute medical advice and does not replace consultation with doctors or pharmacies.
(1) The Platform distinguishes between the following roles with different scopes of functionality: a) Testers: use without registration; submission of reviews without creating an account and without storage of contact details. b) Registered testers: registration with an e-mail address; extended functions, optional newsletter. c) Verified testers: registration with verification by the CT team; mandatory medical history details (indication, diagnosis) for participation in the verified review programme; reviews are given greater weight. d) Doctors: registration with healthcare-professional verification (e.g. DocCheck); access to the healthcare professionals' area and to medical tools. e) Pharmacies: registration with healthcare-professional verification; access to the healthcare professionals' area, option of batch attestation (“Test by the dispensing pharmacy”). f) Manufacturers / wholesalers: registration following review by CT; management of their own product master data, commissioning of laboratory analyses; no submission of reviews. (2) Truthful information must be provided upon registration. Professional roles (d–f) require proof of the respective professional status. CT may reject registrations or revoke verifications if information is inaccurate. (3) Access credentials must be kept secret. Each account is personal or business-specific and non-transferable.
(1) Reviews may relate exclusively to products that were prescribed to the reviewing person by a doctor and duly dispensed by a pharmacy. Reviewing third-party products not obtained by the reviewer themselves is prohibited. (2) Users must not make untrue statements of fact, infringe the rights of third parties or post content that violates applicable law (in particular HWG, AMG, BtMG, UrhG). (3) Trading in, dispensing or offering narcotics via the Platform is strictly prohibited. The Platform does not serve to initiate purchase transactions by patients. (4) When uploading photos or videos, no rights of third parties (copyrights, personality rights) may be infringed. Personal data of third parties visible on label photos must be made unrecognisable before uploading. (5) If content violates these rules, CT may remove it, suspend accounts or withdraw verifications (§ 8).
(1) Users grant CT a simple (non-exclusive) right of use, unlimited in space and time, to posted content (review details, photos, videos) for storage, publication on the Platform, aggregation and scientific analysis within the research cooperation — in each case within the scope of the consents given. (2) Publication takes place in pseudonymised form. Details of data processing are set out in the privacy policy; health-related information is processed only on the basis of separate, granular consent (Art. 9 GDPR). (3) Submitted reviews are checked by CT before publication (moderation). There is no entitlement to publication.
(1) Manufacturers and wholesalers may commission paid laboratory analyses (blind tests) via the research cooperation with Humboldt-Universität zu Berlin. The price is based on the price list valid at the time of commissioning. (2) Commitment to results: the results of commissioned blind tests are published regardless of their outcome. There is no right to withdraw, suppress or subsequently remove the result. The fee is owed in full even if the result is unfavourable to the client. (3) Optional self-presentation profiles are priced uniformly, are labelled “Manufacturer information, unverified” and are technically separated from all quality indicators. (4) The free, neutral product profile (master data in a uniform format) is available to all manufacturers irrespective of paid services.
(1) Access to the healthcare professionals' area (in-depth data, tools, reports) may be subject to a fee. The conditions displayed at the time of booking are authoritative. (2) The fee is charged exclusively for access to tools and data. It is in no way linked to patient referrals or to prescribing or dispensing behaviour.
(1) The visibility, order and presentation of products, manufacturers, pharmacies or doctors on the Platform cannot be bought. Payments purchase services only (analysis, access, self-presentation profile) — never visibility, placement or review results. (2) CT does not accept advertising money, commissions or listing fees and does not display third-party advertising.
(1) Content that is unlawful or violates these Terms and Conditions can be reported to CT via the contact address kontakt@cannabis-transparent.de (notice and action). CT reviews reports promptly and takes the necessary measures (removal, blocking, labelling). (2) Companies affected by reviews (manufacturers, pharmacies) may submit a counterstatement regarding published attribute presentations; it is logged, editorially reviewed and, if suitable, assigned to the entry concerned. Entries are not removed in exchange for payment. (3) Those affected may lodge a complaint with CT against moderation decisions; reasons will be given for the decision. Further statutory rights (including the remedies under Regulation (EU) 2022/2065 — DSA) remain unaffected.
(1) CT strives to ensure high availability of the Platform but does not guarantee uninterrupted accessibility. Maintenance work may lead to temporary restrictions. (2) CT may further develop, change or discontinue functions of the Platform, provided that this does not impair material contractual obligations towards paying users.
(1) CT is liable without limitation for intent and gross negligence and in the event of injury to life, body or health. (2) In the event of simple negligence, CT is liable only for the breach of material contractual obligations (cardinal obligations), limited to the foreseeable damage typical of the contract. (3) CT accepts no liability for the accuracy of the content of user-generated reviews. Reviews reflect exclusively the personal experiences of the respective users. Treatment decisions must not be based solely on Platform content. (4) Liability under the Product Liability Act (Produkthaftungsgesetz) remains unaffected.
The processing of personal data is governed by the Platform's privacy policy. Health-related data is processed exclusively on the basis of separate, express consents that can be withdrawn at any time (Art. 9 GDPR).
(1) The user agreement for free functions runs for an indefinite period and may be terminated by users at any time by deleting their account. For paid services, the terms agreed at the time of booking apply. (2) When an account is deleted, the account's personal data is permanently deleted. Reviews already submitted are retained in anonymised form (research data without personal reference); details are set out in the privacy policy. (3) The right to extraordinary termination for good cause remains unaffected. Good cause exists for CT in particular in the event of repeated or serious violations of § 4.
CT may amend these Terms and Conditions with effect for the future where this is necessary for valid reasons (in particular changes in the law or in functionality). Registered users will be informed of changes in text form at least six weeks before they take effect; if they do not object within this period, the changes are deemed accepted. The notification will expressly point out the right to object and the consequences.
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. With respect to consumers, this choice of law applies only insofar as mandatory consumer protection provisions of the state of residence do not preclude it. (2) If the user is a merchant, a legal entity under public law or a special fund under public law, Berlin is the exclusive place of jurisdiction. (3) Should individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions remains unaffected.
